Biography

    Mr. Hern specializes in employment law and litigation in areas including the Fair Labor Standards Act, state wage, hour and overtime laws, sexual harassment, the Americans with Disabilities Act, Title VII, the New Jersey Law Against Discrimination, executive employment agreements and non-competition agreements. 

    Mr. Hern has also won summary judgment dismissing Federal overtime-pay cases based on the Motor Carrier Exemption of the FLSA. Most recently, Mr. Hern won a unanimous jury verdict in New Jersey Superior Court against claims of sexual harassment and retaliation.

    Mr. Hern also represents clients in other civil litigation, trials and adversary proceedings in matters involving breach of contract and fraud claims, as wells as partnership and shareholder disputes.

    As General Counsel and Partner in FetchForce, LLC, Mr. Hern offers expertise in compliance with regulations of the Federal Trade Commission and with the Federal CAN-SPAM Act. 

    In addition, Mr. Hern is the Mayor of the Borough of New Providence, and serves as a member of the Borough Planning Board. Prior to his election to a four-year term as Mayor in November 2010, Mr. Hern was elected to three terms on the New Providence Borough Council.
